Terms and Conditions for Real Estate Photography Services

1. General

These Terms and Conditions govern the services provided by Photo Artisto Corp., located in Ontario, Canada, referred to as “we,” “us,” or “our.” By booking our services, you (“the Client”) agree to these terms and conditions.

2. Services Offered

  1. 360° Premium Virtual Showcase
    • Includes:
      • Up to 50 professionally edited, high-quality images capturing every corner of properties up to 2,000 sq. ft., with multiple angles.
      • HDR (High Dynamic Range) photography and advanced retouching for vivid colors and balanced lighting.
      • A full-property 360° Virtual Tour, allowing potential buyers to explore each room and area interactively.
      • Virtual Staging for up to 5 rooms, adding tasteful furnishings to help buyers visualize the space.
    • Turnaround Time: 48-72 hours.
    • Note: For properties larger than 2,000 sq. ft., custom pricing applies.
  2. Complete Standard Home Showcase
    • Includes:
      • Up to 30 professionally edited images covering all major rooms, backyard, and additional living areas for properties up to 2,000 sq. ft.
      • HDR (High Dynamic Range) photography for evenly lit, vibrant images.
    • Turnaround Time: 24-48 hours.
    • Note: For properties larger than 2,000 sq. ft., custom pricing applies.
  3. Luxury Aerial Portfolio
    • Includes:
      • Up to 40 high-quality images showcasing unique features and multiple perspectives of properties up to 2,000 sq. ft.
      • HDR photography and advanced editing for flawless lighting and composition.
      • Virtual Staging for up to 3 rooms to showcase furnished spaces.
      • Drone Photography (5-8 aerial shots) to highlight the property and its surroundings.
    • Turnaround Time: 48-72 hours.
    • Note: For properties larger than 2,000 sq. ft., custom pricing applies.
  4. Video Walkthrough
    • Includes:
      • An immersive video walkthrough showcasing the property’s layout and details, designed for properties up to 2,000 sq. ft.
    • Price: $399.
    • Note: Custom pricing applies for larger properties based on video length and quality requirements.

3. Booking and Payment

  1. Booking:
    • All bookings are made online through our website. Bookings are confirmed only after payment has been received.
    • Availability is subject to change until full payment is made.
  2. Payment:
    • Full payment is required at the time of booking.
    • Accepted payment methods: Credit Card, Debit Card.
  3. Rescheduling and Cancellations:
    • Rescheduling requests must be made at least 48 hours in advance. We will accommodate changes at no additional cost, subject to availability.
    • Cancellations made more than 48 hours in advance will be refunded in full.
    • Cancellations made within 48 hours of the appointment are subject to a 50% cancellation fee.
    • No-shows or cancellations within 24 hours of the scheduled session will be charged the full booking amount.

4. Service Conditions

  1. Access to the Property:
    • The Client must ensure the property is clean, staged, and ready for photography at the scheduled time.
    • The Client or an authorized representative must be present during the session or provide access instructions in advance.
  2. Weather Conditions:
    • For drone photography, services may need to be rescheduled due to unsuitable weather. Rescheduling for weather-related delays will be done at no extra charge.
  3. Scope of Work:
    • Services include photography, post-processing, and (if applicable) virtual staging as described in the selected package.
    • Any additional requests may incur extra charges.

5. Image Delivery

  1. Turnaround Time:
    • Delivery times are as follows:
      • 360° Premium Virtual Showcase: 48-72 hours.
      • Complete Standard Home Showcase: 24-48 hours.
      • Luxury Aerial Portfolio: 48-72 hours.
    • Rush delivery may be available for an additional fee.
  2. Delivery Method:
    • Images and virtual tours will be delivered via a secure download link or client portal.
  3. Revisions:
    • Basic revisions (e.g., color adjustments) are included. Additional editing requests may incur an extra fee.

6. Copyright and Usage Rights

  1. Copyright:
    • All images and media created by us remain our intellectual property and are protected under copyright laws.
  2. Client Usage Rights:
    • The Client is granted a non-exclusive, non-transferable license to use the images for the marketing and sale of the property.
    • The images cannot be resold, edited, or reused for other properties without prior written consent.
  3. Portfolio Use:
    • We reserve the right to use any images or virtual tours for our portfolio, website, or marketing materials unless the Client requests otherwise in writing before the session.

7. Liability

  1. Property Damage:
    • We exercise care during the shoot but are not liable for accidental property damage unless caused by gross negligence.
  2. Service Interruptions:
    • We are not responsible for delays or issues caused by circumstances beyond our control, including but not limited to weather, technical malfunctions, or lack of property access.
  3. Client Responsibility:
    • The Client is responsible for ensuring the property is safe, accessible, and in presentable condition at the time of the session.

8. Governing Law

These Terms and Conditions are governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
